Institutional arbitration: an international choice, a national future

José Castro e Solla, Secretary-General of the Commercial Arbitration Centre of the Portuguese Chamber of Commerce and Industry, and Gabriela Steiner, Case Manager, wrote an article for Link To Leaders on the relevance of institutional arbitration.

In the article published on Link To Leaders, José Castro Solla argues that institutional arbitration is a strategic tool for the competitiveness of Portuguese companies, particularly in an international context.

The authors highlight that, in a globalised economic environment shaped by cross-border contractual relationships, predictability, neutrality and specialised dispute resolution are decisive factors. They also emphasise the importance of choosing institutions with experience, credibility and the capacity to manage proceedings efficiently. Clear rules, arbitrator appointment mechanisms and time-limit monitoring contribute to greater legal certainty and efficiency.

The article also points to the need to strengthen, in Portugal, a culture of using institutional arbitration, not only as an alternative to state courts, but as a strategic option in both domestic and international contracts. The central message is clear: institutional arbitration is an internationally oriented choice and an essential instrument for the future of dispute resolution in Portugal.
